Standard Terms and Conditions for Storing a Credit Card on File

1. Authorization

  • By providing your credit card information, you authorize the American Academy of Orthopaedic Surgeons (AAOS) to securely store your card details and charge your card for future agreed-upon transactions, including but not limited to recurring payments, outstanding balances, or incidental charges.

2. Data Privacy and Security

  • AAOS will implement and maintain reasonable administrative, technical, and physical safeguards to protect the confidentiality and security of your credit card Information and ensure that appropriate access controls are in place in accordance with industry standards and applicable laws and regulations. Additionally, AAOS complies with the terms of the AAOS Privacy Policy.
  • Your card information is stored in compliance with PCI-DSS (Payment Card Industry Data Security Standard) and will not be accessible to unauthorized parties. We use a secure, encrypted payment processor to store and manage your payment details.
  • In the event of a data breach involving your credit card information, AAOS will notify you in writing as required by laws; provide you with information about the nature and extent of the data breach, offer standard complimentary credit monitoring and identity thief services for a period of not less than one year; and take appropriate steps to remedy the data breach and prevent similar incidents in the future.

3. Types of Charges Permitted

  • You authorize American Academy of Orthopaedic Surgeons to charge your card for:
    • Recurring subscription or membership fees
    • One-time purchases or renewals
    • Fees for services rendered
    • Late fees, penalties, or past-due amounts (if applicable and disclosed)
    • AAOS will not use your card for any other purpose, unless you provide additional authorization.

4. Notification of Charges

  • You will be notified 30 days in advance of any recurring or significant one-time charges, unless you have opted into auto-renewal or ongoing service billing.

5. Card Updates and Responsibility

  • You are responsible for maintaining up-to-date billing information. If your card is declined, expired, or replaced, it is your responsibility to provide a new valid payment method.

6. Dispute Resolution and Complaints

  • If you believe a charge is incorrect, please contact American Academy of Orthopaedic Surgeons within 7 days of the charge. We will review the claim and provide a resolution within 7 days.

7. Termination or Revocation

  • You may revoke this authorization by contacting us in writing at customerservice@aaos.org, with at least 7 days' notice. Once revoked, no further charges will be made, except for amounts already owed.

8. Limitation of Liability

  • AAOS will indemnify and hold you harmless from any direct damages resulting from AAOS’ negligent or willful mishandling of your credit card information, including but not limited to unauthorized charges made to your credit card as a direct result of a data breach.
  • AAOS’ liability for any damages arising from or related to the storage of your credit card information will be limited to actual, direct damages you incur, not to exceed the great of $1,000 or the total amount of the unauthorized charges made to your credit card as a direct result of a data breach.
  • In no event shall AAOS be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, regardless of whether such damages were foreseeable and whether or not AAOS has been advised of the possibility of such damages.
  • The limitations of liability set forth in this section shall not apply to damages resulting from AAOS’ gross negligence, willful misconduct, or fraudulent acts, or to the extent prohibited by applicable law.

9. Governing Law

  • These Terms and Conditions are governed by the laws of the State of Illinois, without regard to its conflict of laws principles.

10. Consent and Acceptance

  • By saving your card on file, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. You may request a copy of this agreement at any time.
  • You warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms and Conditions.

11. Entire Agreement

  • These Terms and Conditions, together with any other documents incorporated herein by reference, constitute the entire agreement between you and AAOS with respect to the storage of your credit card information.

AAOS Auto-Renewal Terms and Conditions

Effective Date: June 26, 2025

These Auto-Renewal Terms and Conditions ("Terms") govern the automatic renewal of subscriptions, membership dues or services provided by the American Academy of Orthopaedic Surgeons (AAOS) ("we," "us," or "our"). By enrolling in or continuing a subscription or payment of annual membership dues with auto-renewal, you agree to these Terms.

1. Auto-Renewal Policy

  • Unless you cancel your subscription or membership prior to the end of the current term, your subscription or membership will automatically renew for successive periods of the same length (e.g., monthly, annually) at the then-current rate.

2. Billing and Payment

  • You authorize us to charge your payment method on file at the beginning of each renewal term.
  • Charges will include applicable taxes and fees.
  • If payment fails, we may suspend or terminate your access to subscription or limit or terminate your access to members-only sections of the AAOS website until payment is received.

4. Notification of Renewal and Renewal Confirmation

  • Where required by law, we will send you a reminder before your subscription or membership renews, including the renewal date and amount. Once your payment is received, you will receive confirmation that your subscription or membership has been successfully renewed.

5. Changes to Terms or Pricing

  • We may modify these Terms or the pricing at any time. If we do, we will provide notice in advance (via email or your account dashboard). Continued use of the service after changes take effect constitutes your agreement to the new Terms or pricing.

6. Refunds

  • Except where required by law or stated otherwise in our refund policy, all payments for subscriptions or membership dues are non-refundable.
